Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Mikk mobile application ("Mikk," "App," "Service"), provided by MIKK LABS PRIVATE LIMITED ("Company," "we," "us," "our"). By creating an account or using Mikk, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

Mikk is available only to individuals who are 18 years of age or older. By using Mikk, you confirm that you are at least 18 years old. We collect your date of birth at signup solely to verify this eligibility requirement. We also use age-related tools provided by Google Play to restrict access by users identified as minors, and we reserve the right to suspend or terminate any account we believe belongs to a user under 18.

3. Account Registration

To use Mikk, you must create an account by providing certain information, such as your name, gender, and date of birth (used solely to verify you meet the minimum age requirement). You are responsible for:

• ·Providing accurate information.
• ·Keeping your account credentials confidential.
• ·All activity that occurs under your account.

You will be assigned a unique Mikk ID. Anyone who has your Mikk ID can search for you within the App and initiate a conversation with you. You are responsible for deciding who you share your Mikk ID with.

4. How Mikk Works

Mikk lets you exchange typed text messages with another user. Your messages are delivered through an animated 3D avatar using AI-generated voice (text-to-speech), lip-sync, and facial animation. Avatars currently available in the App are pre-made avatars provided by Mikk — you do not upload your own photo, video, or likeness to generate an avatar.

5. Acceptable Use

You agree not to use Mikk to:

• ·Harass, threaten, abuse, defame, or impersonate any person.
• ·Send unlawful, obscene, hateful, or sexually exploitative content, including any content involving minors.
• ·Attempt to contact, groom, or exploit anyone under the age of 18.
• ·Spam, solicit, advertise, or share another user's Mikk ID without their consent.
• ·Attempt to reverse-engineer, scrape, or interfere with the App or its infrastructure.
• ·Violate any applicable law.

We reserve the right to investigate reported violations, remove content, and suspend or terminate accounts that violate these Terms, at our discretion.

6. Content and Reporting

You are solely responsible for the messages you send. Mikk provides an in-app reporting feature so you can flag abusive, offensive, or otherwise inappropriate messages or user behavior. We review reports to inform our moderation and enforcement decisions.

7. Intellectual Property

Mikk, including its software, avatars, branding, and design, is owned by MIKK LABS PRIVATE LIMITED and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You retain ownership of the text messages you write, but you grant us a limited license to process, store, and transmit that text — including sending it to third-party providers such as our text-to-speech provider — solely to operate the App's features.

8. Account Deletion and Termination

You may delete your account at any time via Account → Settings → Privacy & Safety → Delete Account within the App, by visiting mikk.live/delete-account, or by emailing contact@mikk.live. We may suspend or terminate your account if you violate these Terms, or as required by law.

9. Disclaimers

Mikk is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or completely secure. AI-generated voice, lip-sync, and animation may not always perfectly reflect your intended tone or message.

10. Limitation of Liability

To the maximum extent permitted by law, MIKK LABS PRIVATE LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including damages resulting from the conduct of other users.

11. Indemnification

You agree to indemnify and hold harmless MIKK LABS PRIVATE LIMITED and its officers, employees, and affiliates from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Mikk shall be subject to the exclusive jurisdiction of the courts located in India.

13. Changes to These Terms

We may revise these Terms from time to time. Continued use of Mikk after changes take effect constitutes your acceptance of the updated Terms.
